Wilmy is specialised in insolvency law, property law, and the (international) restructuring practice. She primarily advises Dutch and international clients facing financial difficulties and supports managing directors, supervisory board members, and other key stakeholders, including financial institutions, in navigating complex legal issues.

Wilmy has significant experience in handling large-scale insolvency proceedings and focuses in particular on acting as a trusted advisor and guiding international restructuring processes.

Experience
  • Advising the main lender in one of the first and largest WHOA restructurings in the Netherlands, involving a sizeable fitness group operating through multiple entities. Within the framework of the Wet Homologatie Onderhands Akkoord (WHOA).
  • Acting as lead counsel to the interim board of a distressed automotive company in a complex restructuring process involving cross-border elements. Provided strategic and legal guidance throughout the full lifecycle of the engagement. Advised on directors' duties and liability exposure in the context of financial distress, the structuring of the sale process, and the negotiation of transaction documentation.
  • Advising a secured financier in the insolvency proceedings of a Dutch bicycle manufacturer. Provided strategic and legal advice on the client's security position throughout the bankruptcy, including a thorough analysis of the enforceability and ranking of the security package in the context of the estate. Key element of the engagement involved conducting intensive negotiations with the court-appointed insolvency trustee (curator) regarding the treatment and realisation of the secured assets facilitating a restart of the business, ensuring the maximum recovery of value.
