From WHOA to bankruptcy: How Dutch law treats secured creditors

Merijn Moeliker, Alejandra Bouts, and Imke Been have authored the chapter for The Netherlands in the newly published Third Edition of The Treatment of Secured Claims in Insolvency and Pre-Insolvency Proceedings, published by INSOL International.

This authoritative reference work, first published in 2007 and now significantly expanded, covers 29 jurisdictions and is an essential guide for (secured) lenders, other creditors, and restructuring professionals dealing with cross-border secured creditor issues. The Third Edition includes new topics such as security rights over digital assets and cryptocurrency, as well as the latest developments in cross-border insolvency and pre-insolvency proceedings.

The Netherlands chapter covers key aspects of Dutch law, including the treatment of secured claims under the WHOA (the Dutch pre-insolvency restructuring tool), enforcement rights, and the position of secured creditors in bankruptcy proceedings.
