Kirsty is a partner in our real estates disputes team specialising in the resolution of complex real estate disputes. With extensive experience advising clients across the commercial and residential property sectors, Kirsty acts for landlords, tenants, developers, investors, and corporate occupiers on a wide range of contentious property matters.

Her practice encompasses disputes relating to commercial leases (including lease renewals under the Landlord and Tenant Act 1954, dilapidations, rent arrears and break notices), development constraints (including rights of way, restrictive covenants, adverse possession and boundary disputes), contractual interpretation and disputes and also advises on insolvency issues relating to property. 

Kirsty is experienced in advising on strategic risk management and is recognised for her practical, commercial approach and her ability to achieve favourable outcomes for clients through negotiation and, where necessary, robust representation in court proceedings. 

In particular Kirsty is recognised nationally for advising occupiers and investors on their property portfolios, particularly in the retail sector. Her advice has been described by clients as "invaluable" and she is described as “incredibly dynamic” and she is a regular speaker at numerous industry events. 

Experience

Kirsty's recent experience includes:

  • Onboarding and advising a large vetinary practice on a rebrand project across their 1,000 site property portfolio as well as day to day estate issues and renewals.
  • Providing strategic advice to a well known restaurant in Mayfair in its regear discussions with the landlord including advising on the threat of a ground (g) own occupation opposition on the future renewal.
  • Advising a landlord on a multi-million pound dilapidations strategy, including service of a notice to repair, to achieve a settlement which was not curtailed by the section 18 cap as a terminal claim would be.
  • Advising a large Manchester based investor on the impact of the Trocedero decision relating to insurance comissions across their estate, which crosses different sectors.
  • Asset management for a number of landlord clients including training and strategic advice on the impact of legislative changes and upcoming consultations.
  • Acting for a strategic land client to advise on a restrictive covenant threatening a large development scheme having previously been successful at Tribunal in obtaining a modification to a covenant limiting use of land to a public house to allow a development; and
  • Acting for a large house builder on the interpretation of a sale agreement threatening the purchase of an important strategic site.
