With legal expertise that spans disputes, finance, funds, commercial, insurance, reputation management, professional practices and corporate law, we don’t look at litigation finance in a vacuum. That’s because every decision you make has a knock-on effect, often encompassing multiple practice areas. So, to give the most informed advice, we draw on expertise from across our firm – whatever the sector or specialism.

Financing a Dispute

We look at the available options and advises on how a case could be funded. This can include third-party funding, CFAs, DBAs, ATE insurance, portfolio funding and bespoke arrangements.

We know what all the parties are thinking, how they will approach the case and, as a result, provide more holistic, informed and complete advice.

Ensure Disputes are Worth Funding

We help companies and funders decide which disputes to fight. Our CONTROL offering includes legal and commercial case assessments. We can advise you on the claim you may be seeking to fund, your template agreements, or help develop the best way to structure a bespoke funding arrangement.

Fund Arrangement Structure and Negotiation

We advise on the mechanics and terms of funding, including single-case funding, portfolio funding, bespoke structures, funding agreements and contingency fee arrangements. We also advise funders themselves on claims they are considering funding.

A Risk-Sharing Partner

We regularly enter into risk-share agreements and offer our own alternative fee arrangements. For example:

DBA: AG may receive no fees during the case and instead take an agreed percentage of damages if the claim succeeds.

CFA: the client pays a reduced fee during the case, with further fees and potentially a success fee payable if the agreed outcome is achieved.

We can then act as the lawyers on the dispute itself. Through CONTROL we help assess your case, arrange and structure the finance, share some risk where appropriate, and then litigate the case.
