Samuel acts for pension trustees and pension scheme employers on both contentious and non-contentious matters. Samuel’s non-contentious pensions experience includes providing pensions due diligence support on corporate transactions which includes advising on auto-enrolment issues. Advising on GDPR related issues and preparing scheme GDPR documentation. De-risking work including preparing and reviewing benefit specifications and advising on buy in and buy out. Advising on surplus, PPF entry requirements / regulations and GMP equalisation. Samuel also has experience advising trustees of risks arising from the UK sanctions regime.
- Experience
Samuel’s pensions litigation experience includes working on:
- Part 8 rectification claims rectifying historic mistakes in pension scheme documentation.
- Defending claims against SIPP operators for mis-sold pensions. This included working on a Court of Appeal judicial review.
- Part 8 construction claim asking the Court to determine an interpretation contained in pension scheme documentation.
- Part 8 corrective interpretation claim asking the Court to correctively interpret an obvious mistake in the pension scheme rules.
- Claims for ill-health under the pension scheme rules and a strike out application to have the claim struck out.
- Successfully defending LDI Claims.
- Managing large scale IDRP responses arising from complaints issued against a large DC Master Trust.
- Litigation arising from overpayments / underpayments and issues with administering a pension sharing order.
- Part 7 professional negligence claims against the scheme’s advisors.
