Expertise

Charlie is a Partner in the Construction and Engineering team with significant experience in the resolution of complex, high-value construction and engineering disputes, both internationally and domestically.  He is experienced in all main forms of dispute resolution, specialising in international arbitration and English High Court litigation.  He represents clients including owners, developers, contractors, consultants, engineers and insurance companies in respect of distressed projects around the world, spanning a number of sectors.

Experience

Representative experience includes:

  • Acting in an ICC Arbitration related to the design and construction of a leading chemical production facility located in Russia, with a total sum in dispute in excess of €1.4 billion.
  • Acting in an ICC Arbitration concerning numerous highly technical issues arising out of the design and construction of a globally significant maritime project in Central America, including 6 geotechnical claims brought by contractors concerning the largest earthfill dams in the world at the time of construction, and a highly technical dispute over the design development of a lock gate guiding, bearing and sealing system.
  • Acting in TCC litigation regarding multiple technical defects to a PFI funded healthcare facility in the UK, with a quantum of approximately £600 million.
  • Acting for an architect in TCC and Court of Appeal proceedings related to a mixed-use retail and residential project in the UK, with a quantum of approximately £70m. 
  • Acting in High Court Proceedings brought by an employer against onshore and offshore contractors, successfully obtaining and extending an injunction preventing issuance of proceedings in jurisdictions other than the UK to block payment of on demand bonds.
  • Acting in High Court Proceedings on behalf of an employer against two banks for non-payment of on demand bonds.
  • Acting in ICC Arbitration regarding the suitability of available material for aggregate and concrete production in a major maritime project in Central America, including technical evidence in respect of drilling, blasting and stockpiling methodologies, with a quantum of approximately $550 million.
  • Acting in ICC Arbitration concerning the design and fabrication of lock gates for major maritime project in Central America with a quantum of approximately $300 million. 
  • Acting for an international design engineering consultancy in respect of allegations of defective design of five multi-level car parks at retail sites.
  • Acting for a structural design engineer and its professional indemnity insurer in respect of defects to multiple onshore wind turbine generator foundations across five wind farm sites.
  • Acting for a leading property and infrastructure practice in defence, and subsequent strike out of TCC proceedings arising out of alleged defects to a proprietary modular car park system.
  • Acting for an international engineering consultant in an ICC arbitration regarding the design and construction of a hotel and conference complex in Abu Dhabi.
  • Acting for an international consulting engineering practice and its professional indemnity insurer in defence of TCC proceedings, to successful strike-out of the claim.
  • Acting for a structural design engineer in respect of complex multi-party litigation in the TCC concerning alleged defects to the foundations of a number of commercial property units.
  • Acting for an international structural design engineering consultant based in Denmark in respect of a TCC claim regarding defects to an offshore wind farm development.
