Looking at key cases from the past 12-18 months, Jonathan will draw out drafting and practical points with the aim of leaving everyone with something to take back to their desks and use in practice.

Examples of areas to be covered include:

  • The latest Supreme Court FM case
  • Limitation and exclusion of liability, particularly liability caps and set-off
  • Relational contracts and good faith
  • What is the scope of a “loss of anticipated profits” exclusion?
  • Cases on third party rights and interest for late payment
