The EU Data Act starts to enter into application on 12th September 2025, introducing harmonised rules on access to and use of data within the EU. Due to the Data Act's territorial reach, it also applies to non-EU organisations that place in-scope products or services on the EU market. In the UK, the Data (Use and Access) Act 2025 gives the government the power to create Smart Data schemes, which will enable consumers to request organisations to share their data with authorised third parties and establish a framework to ensure the security of the data.
In this webinar our EU and UK data specialists will cover the following:
- The scope of the EU Data Act
- The Data Act's impact on terms of business, including transparency requirements and contractual clauses
- Data accessibility by design
- The Data Act's rules on international data transfers
- The "trade secrets handbrake"
- Smart Data schemes, including their relationship to the UK GDPR
- What we know so far about the government's plans for Smart Data
