Andrew Park is a managing associate and has experience advising clients on a board range of disputes, including claims for breach of contract, insolvency disputes, group proceedings, judicial reviews, health and safety prosecutions, fatal accident inquiries, disciplinary and regulatory proceedings.
Andrew’s other area of expertise is in the sports and disciplinary area. Andrew has provided advice to some of the largest sports governing bodies in Scotland and England. He has been involved on assisting with drafting and implementing new disciplinary rules for governing bodies in Scotland. He has also acted for a number of players/ athletes in a wide range of sports and regulatory matters.
He has appeared in court on behalf of clients in respect of a wide variety of court and tribunal hearings, including interim orders, debates and proofs, public inquiries, criminal matters, disciplinary and regulatory proceedings.
Andrew has regularly attended at interviews conducted by Public Authorities and Police on behalf of directors and public employees in respect of both Criminal and Regulatory matters.
- Experience
- Successful court application for interim orders for the delivery of good valued in excess of £7million+ together with the defence of claim for fraudulent rendered invoices;
- The successful judicial review challenge against Scottish Government for failing to follow the correct procedures for an internal investigation;
- The successful defence of a claim for payment of fraudulently rendered invoices rendered invoices relating to invoices totalling £350,000 for works related to a £300 million R&D Centre;
- Advising and defending Group Proceedings raised against a tea manufacturer relating to personal injury claims which involve jurisdictional issues including proceedings in foreign jurisdictions;
- Successful defence of a challenge, by judicial review, of a decision to refuse an application relating to offshore wind farms;
- Advising a world-wide oil company group in a complicated fraud claim against a party in Scotland. The work included multiple actions across various jurisdictions and proceeding with recovery of documents by way of “dawn raid” procedures;
- Advising and successfully pursing a claim in the High Court of England revolving around allegation of breach of fiduciary duties against a former director;
- Advising and carrying out internal investigations for a leading construction and property services company in connection with an allegation of Bribery by a significant supplier on a government contract;
- The defence of a sole trader in health and safety prosecution in a respect of a well-known Scottish theme park;
- Acting on behalf of one of the UK’s largest Sports Governing Bodies in respect of a number of detailed regulatory investigations;
- Prosecuting players and club officials on behalf of one of Scotland’s largest Sport Governing Bodies in respect of alleged breaches of disciplinary rules;
- Advising on a successful non-domestic rates appeal before the Local Taxation Chamber;
- Acting on behalf of a director with a criminal allegation of Fraud by HMRC, which was prosecuted by COPFS on indictment;
- Advising on an opposition to extension to moratorium period under Proceeds of Crime Act 2002;
- Attending various Interviews (including interviews under caution) in respect of investigations by Police, Health and Safety Executive, SSPCA and HMRC.
