Mohammed Al Siyabi is an associate based in our Oman office and specialises in litigation.

Mohammed is licensed to appear before the Primary Courts of Oman and holds a Bachelor of Laws from Sultan Qaboos University.  For the past five years, Mohammed has appeared as an advocate in a number of court hearings both in Muscat and in regional centres.  He has extensive experience in all aspects of commercial litigation, including shareholder disputes and banking litigation.

Mohammed has also successfully represented many clients in white collar crime related investigations.  Mohammed also has extensive experience acting for employers in labour related disputes, including mediations before the Ministry of Manpower.

Experience
  • In a complex trademark dispute, our client faced allegations of brand infringement. Despite an initial expert report favouring the claimant, we turned the case around with an innovative consumer survey, showing 90% of respondents found no significant similarity between the trademarks. This evidence secured a decisive win in the Primary Court, affirming our client’s brand distinctiveness.
  • Successfully defended our client in a dispute over the suitability of a Covid home testing kit. Initially, the Primary Court ruled against our client, however, on appeal we secured the appointment of an independent expert, whose findings—supported by the manufacturer—confirmed the kit’s suitability for home use. This evidence led to the reversal of the judgment, dismissing the case entirely.
  • Representing the Omani subsidiary of a global energy infrastructure provider in a shareholder dispute. This case is pivotal in shaping the interpretation of Oman’s evolving foreign ownership laws and holds significant implications for foreign investment strategies in the region.
  • Representing a board member in a high-profile criminal investigation and subsequent court case involving a case value of OMR 52m.
  • Acting as Omani counsel for a consortium of international lenders regarding a dispute relating to a key piece of Omani infrastructure subject to an attachment order by a former subcontractor of their borrower, following an arbitral award issued in Singapore.
  • Successfully defended an Oman-based construction company before both the Primary Court and Appeal Court in an employment dispute filed by its former employee in relation to alleged unpaid commissions/incentives with secondary claims for end of service gratuity and backdated annual leave compensation and secured substantive judgments from both courts in our client's favour, dismissing the incentive claim for OMR 1 million (approx. USD 2.58 million).
