Expertise

Khoti joined the Infrastructure, Projects and Energy Team as an Associate (New Zealand qualified) in October 2024.  Prior to that, Khoti was a Senior Solicitor with one of New Zealand's leading corporate/commercial law firms, during which time she was involved in a range of large-scale infrastructure projects for both public and private sector clients. In addition, Khoti has significant litigation and regulatory (largely in the health and safety space) experience in the New Zealand jurisdiction. Since joining Addleshaw Goddard, Khoti has worked with both public and private sector clients in the transport, water and defence industries, including in relation to large-scale procurements and complex services agreements.

Experience
  • ScotRail Trains Limited: Assisting with a rolling stock procurement programme, with such procurement encompassing both the leasing of, and maintenance services required for, a fleet of trains to replace ScotRail’s current HST fleet. In addition to advising on the procurement itself (including assisting with the drafting of key procurement documents, and attending information sessions with Bidders), Khoti has also assisted with the drafting of the Technical Support and Spares Supply + Agreement, a complex agreement combining both maintenance and technical support services requirements. In addition to this procurement, Khoti has also assisted with the amendment and restatement of existing leasing and maintenance agreements, providing the client with advice in relation to necessary drafting updates, progress these updates, and then negotiating and agreeing the same with the other parties to these agreements. 
  • Ministry of Defence: Assisting with the drafting and development of multiple engineering and support services agreements, and supporting the client with an associated procurement workstream (including attending Bidder Negotiation forums). Khoti’s involvement with these matters has included progressing drafting in relation to matters such as Change, Supply Chain and Sub-Contracting, and Governance, and liaising with the client to resolve outstanding issues in relation to the same.
  • Water Reforms (New Zealand): Advising a New Zealand government department on large-scale water reforms (intended to improve the regulation of, and supply arrangements in relation to, drinking water, wastewater and stormwater across New Zealand).  Khoti was involved in the drafting and review of various pieces of legislation, and co-ordinated and attended a series of workshops to progress and finalise the same.
  • PPP Roading Project (New Zealand): Advising Head Contractor in relation to public-private partnership motorway project, including dispute resolution processes following breakdown of relationships between major parties and subsequent restructuring of key contractual arrangements. As part of this, Khoti attended a lengthy series of negotiations, and co-ordinated between the client and firm teams to produce key advice following these sessions. Khoti was subsequently seconded as commercial manager to the client company, during which time she managed day-to-day correspondence with the relevant Contractors, advised on contractual interpretation queries, and managed the ongoing dispute.
  • Light Rail Project (New Zealand): Advising New Zealand government department on Light Rail project (which aimed to improve mass transit systems, as well as develop and construct urban regeneration along the rail route).
