Paul specialises in construction and engineering law and has over 20 years experience of advising clients on contracting arrangements on major infrastructure projects in Saudia Arabia, Qatar, Dubai, Abu Dhabi, Oman, Africa, Russia and the United Kingdom. He has been based in the Middle East since 2012.

Paul has substantial experience advising government departments, investors, sponsors, developers, lender clients, D&B and EPC contractors on major construction and infrastructure projects in the Middle East, including GIGA projects in Saudi Arabia. These have included logistics facilities, airport, road and heavy rail engineering infrastructure, stadia infrastructure and facilities, independent sewage treatment plants, and renewable energy projects in the Middle East and globally.

Paul is a FIDIC expert and has drafted FIDIC based contractual documentation for a broad range of rail, metro systems, and light rail projects in the Middle East.  Paul will also draw up his contentious arbitration rail experience and lessons learned for the development of the contract documentation for this rail project.

Experience

Experience includes:

  • Metro Project in the Middle East - acting for the successful joint venture international contractors, as respondent, in an ICC arbitration in relation to a dispute in excess of $25m brought by the designer, as the claimant in these arbitral proceedings. This dispute involved a two-week merits hearing held in 2022 and the Final Award was issued in the international contractor's favour (our client). This involved technical design issues, variations, extension of time, prolongation and disruption claims brought by the designer and the contractors' claim for milestone delay damages for delays caused by the designer. Paul led the team on this dispute from drafting the Statement of Defence and Counterclaim, leading on instructions to the experts for delay, technical engineering, and quantum, attending the virtual merits hearing and until to receipt of the Final Award in our client’s favour. 
  • Major Stations Metro Programme in Middle East - advising and providing legal support to an unincorporated joint venture contractor for the design and build package 5 Major Stations for Education City and Msheireb Station in Qatar. This work has included providing advice to the JV contractor on multiple discrete issues during the project delivery phase of the project. This involved attending the site office regularly and advising on live issues including entitlement under the contract and at law, the claims process, and providing general legal support over an eighteen-month period. This also involved drafting contractual documentation for the procurement of several works' packages, advising on procurement matters and claims documentation under the main contract. 
  • Major Stations Metro Programme in Middle East - advising and providing legal support to the lead member of the consortium for the unincorporated joint venture contractor on the Redline North Metro Railway Project in Qatar. 
  • Major Stations Metro Programme in Middle East - advising and providing legal support providing legal support to a joint venture international contractor on the Redline South Metro Railway Project in Qatar. 
  • Major Stations Metro Programme in Middle East - advising and providing legal support providing legal support to the joint venture contractor bidding for the system packages for the Metro Railway Project in Qatar. 
  • Major Stations Metro Programme in Middle East - advising and providing legal support providing legal support to the major specialist subcontractor on the system packages for the Metro Railway Project in Qatar. This involved substantial legal support on the contractual documentation and local law issues, including drafting of contractual documentation. 
  • Major Stations Metro Programme in Middle East – advising and providing legal support providing legal support to a bidder for the consultancy services for long distance passenger and freight for civil, infrastructure and MEP works as part of the Metro Railway Project in Qatar.
  • Major Stations Metro Programme in Middle East - advising a joint venture international contractor on its template suit of subcontracts and performance security for its major rail infrastructure projects in Qatar.  This included drafting a broad range of project documentation. 
  • Rail Infrastructure Programmes in Middle East - advising a joint venture international contractor in connection with multi-billion-dollar rail infrastructure projects in UAE and Saudi Arabia. This involved discrete advice on contractual and local law issues.
  • London 2012 Olympics: Angel Lane Rail Freight Loop and Rail Platform Extension – advising the Olympic Delivery Authority on the procurement of the construction of a platform extension and associated track works split into two separate phases.  Paul was also involved with the asset protection agreement and the implementation agreement (agreement governing the signalling works to be procured by Network Rail for this project) between the Olympic Delivery Authority and Network Rail and this included the flow-down of specific obligations from these two types of agreements with Network Rail into the construction & engineering contract. 
  • London 2012 Olympics:  West Ham Station Capacity Enhancement Works – advising the Olympic Delivery Authority on the procurement of the design, construction, the planned preventative maintenance and de-commissioning of the temporary capacity enhancement works and ancillary works at West Ham Station. This work included negotiation of an asset protection agreement with Thames Water and London Underground.  Paul was responsible for drafting bespoke amendments to the conditions of contract and other contracts documentation to flow-down specific obligations from these two asset protection agreements into the construction & engineering contract. 
  • Light Rail System - advising a local authority on the procurement of the utility diversion works package using a hybrid engineering and construction contract split with a target cost- and cost-plus arrangement with a fixed fee for the light rail system. This involved drafting the engineering and construction documentation and advising on procurement matters. 
  • Light Rail System - advising a local authority on the procurement of the extension and enhancement works for a light rail system. This involved drafting the contractual documentation for these works and advising on procurement strategies and drafting all of the engineering and construction documentation for the new build light right systems and extension works.
