Samantha is a Legal Director in our commercial dispute resolution team.

Samantha qualified in 2003, and has a broad experience in advising businesses and individuals on a range of contentious commercial and personal matters involving contractual and tortious disputes, disputes arising out of corporate transactions (including warranty claims, shareholder disputes, partnership and joint venture disputes), restrictive covenant disputes, reputation management issues, pensions litigation, contentious trusts, and professional negligence matters.

Samantha has considerable experience in supporting corporate transactional matters including analysis of litigation risks and assisting with the drafting of corporate and commercial agreements to minimise litigation risk in the future, and advising in relation to the termination of commercial contracts.

Samantha's practice includes advising on and guiding clients through alternative dispute resolution, including mediation, to achieve commercial settlements where possible, and where it is not, pursuing matters to trial as necessary.

Experience
  • Acting for the defendant in the defence of a breach of contract claim in respect of a sole supply agreement.
  • Acting for a defendant and counterclaimant in a long-running joint venture dispute relating to numerous property development projects, for a reciprocal account and enquiry, and damages claim.
  • Acting for trustees in a professional negligence claim relating to errors arising in the drafting of trust documentation resulting in unintended tax liabilities, as well as seeking to rectify the errors by way of court application.
  • Acting for trustees of a pension scheme in relation to the successful rectification of errors in the trust deeds by court application.
  • Advising a purchaser in a corporate transaction on the settlement of a dispute relating to breaches of warranties and alleged fraud resulting in a multi-party settlement and restructuring arrangement.
