This dedicated and experienced team of specialist asset finance lawyers has extensive knowledge of the asset finance and leasing industry. Clients include banks and other financial institutions, the captive leasing and asset finance subsidiaries of a number of UK and international banks, lessors finance brokers, intermediaries and lessees.
Addleshaw Goddard's Asset Finance team is committed to provide first class, comprehensive advice to clients involved in asset finance and leasing. This financial specialism of the firm effectively operates as two separate but complementary niche practices. Andrew Maskill's team in Manchester handles a broad range of domestic asset finance and leasing matters with a strong London / South East emphasis in terms of client base and source of instructions. Rory MacCarthy's team in London concentrates exclusively on international aviation financing and leasing for a strong domestic and international client base.
The team undertakes a broad range of work, from complex structured transactions to tax, regulatory and compliance advice. We have experience of dealing with a very wide range of assets including electricity and power plants, wind turbines, computer hardware and software, industrial plant and machinery, fixtures, commercial vehicles, telecommunications equipment, medical equipment, aircraft, ships and railway assets. The structures often involve joint venture relationships between manufacturers, finance houses and lessees in relation to the sharing of risk in the assets and their use.
The team advises on specialist areas including:
- Equipment leasing (including finance and operating leasing, hire purchase, and tax based structures)
- Financing of receivables (including sale and purchase of lease portfolios, due diligence in relation to the acquisition of leasing companies, invoice discounting and blocking)
- Energy / power projects (including "green" energy projects, CHP projects, and transactions under the affordable warmth programme)
- Funding of medical equipment (including PFI projects)
- Structuring, brokerage and introductions agreements, purchase agency, collection agency and sales agency arrangements
