Innovative solutions for costs control and risk transfer in the litigation marketplace.
Legal costs will be one of the biggest concerns of any party involved in a dispute. Since launching CONTROL, an innovative suite of litigation funding solutions, in 2008, Addleshaw Goddard has been a pioneer of litigation funding and at the forefront of sharing risk with clients on large and complex commercial cases.
We believe our approach to litigation funding sets us apart from the competition and we are determined to remain at the forefront of thinking in this area. We provide an integrated solution, including conditional fee agreements (CFAs), after the event insurance (ATE) and third party funding (TPF) to provide clients with greater certainty over the potential financial outcomes. Damages based agreements (DBAs) may also have a place in certain types of litigation, but in our view the regulations governing their use are currently unclear and could leave parties exposed to satellite litigation.
Changing landscape
The litigation landscape is set to see significant changes as a number of Lord Justice Jackson's recommendations on civil litigation costs are brought into force in England and Wales in April 2013.
View our guide to the reforms to find out more about the changes.
They will introduce significant changes to the way in which litigation is funded and how costs are managed.
Our approach to funding and investment in CONTROL ensures we are one step ahead in understanding the risk and opportunities for our clients in the new litigation costs world.
Proven track record
The litigation landscape may be in a state of flux with the Jackson reforms, but our approach to litigation funding remains unchanged. As a recognised market leader in commercial litigation funding, no other large law firm has embraced innovative funding in the same way as Addleshaw Goddard, or stood shoulder-to-shoulder with its clients on as many high profile and commercially complex cases. We have shared risk with our clients through conditional fee agreements in more than 100 cases over the last 5 years.
We are committed to working with our clients to identify and put in place the most appropriate funding and risk management solution for each individual case. Over the years we have formed strong relationships with the leading funders, insurers and brokers and gained a wealth of experience of how different funding options work in practice. Even if funding isn’t appropriate for a case, we may be able to offer a range of innovative options, including fee caps and fixed fee arrangements, all with the aim of ensuring our clients have greater cost control and certainty.
